EXP Electronic Trading Agreement
Version: EXP-CONTRACT-v1
Parties: Buyer ("Party B") and MMO.EXP Platform ("Party A")
Effective Date: Upon Party B's electronic confirmation and successful payment.
Article 1 · Subject Matter
Party A transfers to Party B the full right of use and control of the game account specified in this order (including the account, initial password, and original registration email). The account is a new account produced by Party A in compliance, having passed batch full inspection. Specifications are subject to the product detail page snapshot (quality inspection archive number).
Article 2 · Delivery and Time Limits
After Party B's successful payment and execution of this Agreement, Party A shall complete delivery within 12 hours via email and the order page.
Party B shall complete the account binding (rebinding) promptly upon receipt of the account and password.
Warranty Period Commencement: The warranty period commences upon order completion.
Article 3 · Warranty and Compensation
The selected warranty tier at checkout (Basic · 100 days / Assured · Lifetime) is written into this Agreement and may not be changed, upgraded, or refunded after delivery.
Account Recovery Compensation: If the account is recovered during the warranty period, Party A initiates a 15-day recovery period: if recovery succeeds, the original account is returned; if recovery fails, Party A shall compensate 100% of the transaction price, and the compensation shall be refunded via Party B's original payment method.
Ban Replacement (Assured Tier Only): If the account is banned due to reasons attributable to Party A (the ban violation occurred before delivery and was not displayed during inspection and delivery), resulting in permanent ban or a single ban duration of ≥30 days, and remains unbanned after the 7-day appeal assistance period expires, Party A shall replace it with a new account of the same game and equivalent specifications free of charge; ban replacement (including reasons attributable to Party A and official policy changes) is limited to 1 time in total, and after replacement, this benefit is exhausted, while the recovery warranty continues to be valid and is inherited by the new account. The Basic tier does not include ban replacement and only provides appeal guidance and documentation support.
Official Policy Changes: Bans caused by official game policy changes (evidenced by official announcement or ≥10 concentrated bans in the same batch) are excluded from compensation. Bans shorter than 30 days are not eligible for replacement; Party A may provide appeal assistance.
Claim Filing Deadline: Party B shall initiate a claim within 30 days of discovering a recovery or ban; claims filed after the deadline or without valid proof may be declined by Party A.
Account Ownership: After compensation is completed, all subsequent rights arising from recovery or unbanning of the target account vest in Party A; after replacement, all subsequent rights arising from unbanning of the originally banned account vest in Party A.
"Lifetime" Definition: For the Assured tier, "Lifetime" means the earlier of: (a) the official end-of-service of the game as announced by the publisher; (b) ten (10) years from delivery.
Article 4 · Exclusions (Six Items)
Account Transfer: Warranty is immediately void if the account is resold, shared, leased, or used for any commercial purpose;
Party B Violation: No compensation if the account is banned due to Party B's use of cheats, scripts, or other violations;
Party B Negligence: No compensation for losses caused by Party B's disclosure of account information or failure to enable two-factor authentication, provided that Party A's systems were not concurrently compromised;
Post-Delivery Recharges: Amounts recharged by Party B after delivery are excluded from compensation;
Fraudulent Claims: If Party B falsely reports recovery or forges evidence, Party A has the right to report the matter to relevant law enforcement authorities as suspected fraud and suspend Party B's account pending investigation;
Evidence Standard: Recovery facts and liability shall be determined based on platform handover records (inspection snapshots, binding receipts, login logs) as prima facie evidence, subject to applicable law and the dispute resolution mechanism of this Agreement.
Article 5 · Evidence Preservation and Verification
Upon execution, this Agreement generates a contract number and trusted timestamp. Signing behavior (confirmation time, IP, contract version number) is preserved as evidence. Party B may contact customer service at any time with the contract number to request verification.
Article 6 · Dispute Resolution
Good-Faith Negotiation: Any dispute arising from this Agreement shall first be resolved through good-faith negotiation between the parties.
Governing Law: This Agreement is governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. If Party B is a resident of California, this Agreement does not affect any rights Party B enjoys under the California Consumer Privacy Act (CCPA/CPRA) and the California Civil Code.
Dispute Resolution: If negotiation fails and exceeds 30 days, either party may submit the dispute to the American Arbitration Association (AAA) for binding arbitration in accordance with its then-current Consumer Arbitration Rules. The seat of arbitration shall be Wilmington, Delaware, and the language of arbitration shall be English. The arbitral award shall be final and binding on both parties. This arbitration clause does not preclude either party from seeking relief in a small claims court of competent jurisdiction.
Consumer Statutory Rights: Nothing in this Agreement affects any statutory rights Party B may have under applicable consumer protection law, including but not limited to the Magnuson-Moss Warranty Act and the laws of Party B's state of residence.
Data Protection: Personal data processed under this Agreement is handled in accordance with EXP's Privacy Policy, which complies with CCPA/CPRA, GDPR, and applicable data protection regulations.
Claims Channel: Party B submits the order number and electronic contract via "Contact Customer Service" on the order page; a customer service ticket will be generated, and Party A will respond within 12 hours.
